Residents in the community of Belwood near Elora, are protesting a planned wind turbine project. Construction of four turbines near Bellwood will begin next year. Residents are afraid another 30 will follow. Janet Vallery and her neighbours believe the turbines will reduce the value of their property by half. “We’re battling all over rural Ontario supporting each other against the industrialization of rural Ontario.” Officials with Centre Wellington told the province it won’t willingly accept any more turbines. With the wind industry in its death throes the only thing left is the small matter of compensating victims for all the physical and mental harm caused by its giant fans. Think of it as “the last round-up”.

The obvious cause of action – where noise from a neighbouring property causes sleep disturbance – is common law nuisance.  One man from Oregon in the US has just started proceedings citing nuisance and trespass. The tort of nuisance is alive and well in Australia – it’s what gets late-night music venues in cities and suburbs shut down all the time.

But STT’s pretty sure that the tort of “trespass” is not open to plaintiffs suing wind developers or turbine hosts in Australia: here – “trespass” requires the interference with property to be physical and direct.

At the Aug. 1 regional council meeting I attended Mr. Tom Rankin was heard in a loud angry voice giving the entire council gallery the label of NIMBYs. Of course he did not include himself even though they are not being built in his backyard. Rankin continued spewing out his displeasure that council had the audacity to vote in favour of Wainfleet and West Lincoln declaring themselves unwilling hosts to wind turbines in their municipalities. A grateful thank you goes to those councillors who had that courage to recognize that Canada is a democracy.

There has been a back and forth argument whether wind turbines do cause serious health issues. But, on the other hand, gravely speaking why would people be leaving their beloved homes that they worked a lifetime for? Leaving their highest investment of their lifetime? Well – knock us down with a feather – if things didn’t just get a whole lot worse for wind weasels and their highly-paid apologists.

A few posts back you’ll remember the wind weasels’ pinup boy, Russell “Rusty” Marsh tossing up a whale of a tale.

When faced with research done over 30 years ago – which unequivocally linked low frequency turbine noise to health impacts suffered by nearby residents – Rusty spun into action and spruiked that – comparing modern turbines with turbines from the 80s is like comparing “iPads” with “Ataris”.

It’s what STT now calls the “Atari defence”.  Thanks Rusty.
