How The Green Energy Transition Is Destroying Germany’s Nature

Germany’s climate and energy policy is the main threat to bio-diversity. Politicians, however, have closed their eyes from the destructive effects of the rampant expansion of renewable energy.

Dankwart Guratzsch has convincingly described the destruction of the environment by the energy transition in these pages. The mayor of Tübingen, Boris Palmer (Green Party), responded in an article, saying: “Everything is not so bad. The impact of wind farms on nature is almost zero … The only relevant negative aspect of wind power is the optical … Many wind farms attract visitors, who do not find repulsive.”

What a devastating form of denial by the Green mayor. But he shares the fatal disregard for the destruction of nature with many greens who – helped by the WWF and Greenpeace – open up forests and premium areas of natural beauty for businesses and belittle the intrusion by wind turbines into nature.

More and more citizens are beginning to realise how the green energy transition is at odds with nature conservation and environmental protection in Germany. A grassroot protest movement has started with thousands of local citizens’ initiatives, barely connected with each other, who are against the planting of biofuels far and wide and which is destroying biodiversity, against the threats to indigenous birds by wind turbines built in forests, and against the devastation of unique cultural and landscape areas by photovoltaic excesses.

A biodiversity disaster

Of Germany’s 115 most common bird species, 51 have declined significantly in the last 20 years. The head of the biosphere reserve in Schorfheide, Martin Flade, speaks of a “biodiversity disaster” which is due to “the hectic climate, energy and agricultural policy: In the corn farmland birds have no chance – the field processing falls in the breeding season, and later they hardly find any insects to eat in these mono-cultures. Of the 30 most common species, there are just four that could hold their numbers, all the rest are declining since at least since 2007.”

The Lesser Spotted Eagle, also called Pomerania Eagle, became extinct in Saxony-Anhalt last year. Only 108 breeding pairs remain in Germany. It finds less and less food in the declining grassland and open meadow. The distances between breeding sites and food areas are getting longer and are also increasingly endangered by wind turbines.

Notably countries with Green Party ministers (North Rhine-Westphalia, Rhineland-Palatinate, Baden-Wurttemberg, Brandenburg and Hessen) have approved regulations which open the use of forests for wind turbines. To place a wind farm every 500 meters in the forest, six meter wide open lanes have to be cut through the forest in order to transport the 100-ton turbines and to maintain them later. Around each turbine, a five-acre open area must be created to lift the blades by giant cranes.

Wind farms in pristine forests

What a wind farm forest looks like can now be seen in many parts of Germany – for instance around Soonwaldsteig, a part of the Hunsrück, one of the last great, largely untouched forest areas in Rhineland-Palatinate with high biodiversity and the presence of numerous highly endangered species. There, the project developer Juwi has erected eight wind turbines in the middle of a forest – despite public protests – and then sold the park to an Austrian energy supplier. Faced with the images of demonstrating citizens, the Green minister Evelin Lemke could only come up with: “Without climate protection, there will be no more biodiversity here.”

But a policy that overestimates the dangers of climate change and that subordinates all other policy objectives, including nature conservation, whatever the cost, generates resistance. The Soonwaldsteig has become a nationwide focal point of citizens’ initiatives against the use of wind power in sensitive areas.

Today, 200,000 dead bats are found under wind turbines annually. The clever animals locate the rotors, fly through them and in the lee behind the turbines, where the air pressure decreases sharply, the bats’ lungs burst. Particularly affected are the noctule, the Serotine, the Small Noctule or the parti-colored bat. The female bat only gives birth to one or two young per year, thus these useful insectivores are endangered by a further uncontrolled construction of new wind turbines.

The red kite is acutely threatened

Following the review of the German Council for Bird Preservation (DRV) and the umbrella organization of German Avifaunists (DDA, 2012), the Red Kite is also in particular danger. After an investigation by the State Ornithological Institute of Brandenburg, the Red Kite is no longer safe in this state with its 3,200 wind turbines. About 300 Red Kites are killed annually in Brandenburg alone by wind turbines.

The decline of the red kites since 2005 in West Germany is striking, as Klaus Richarz, former head of the State Ornithological Institutes for Hesse, Rhineland-Palatinate and Saarland, has warned. For him too, windmills built in the habitats of kites are fatal for the birds. The protection of the Red Kite is of special obligation for Germany, because a large percentage of the global population of the birds live in Germany. If you like, it is the real national bird of Germany.

In his hard-hitting article “From the energy transition to biodiversity disaster” Martin Flade, the recognized bird expert, describes climate protection and energy policy as a “major threat to biological diversity”. He concludes: “Overall, you have to draw the bitter conclusion that effects of climate change on biodiversity are hardly detectable; the effects of climate and energy policies, however, are dramatic.”

The problem with intermittent wind turbines

Tübingen’s mayor Boris Palmer demands: “We need to double the number of currently 25,000 wind turbines in order to supply Germany.” What a mistake!

Even 50,000 wind turbines only lead to massive surpluses if the wind blows. Wind turbines have on average around 2,500 full load hours per year, but the year has 8,760 hours. In times of no wind, no electricity is generated, even if one multiplies the number of facilities. Zero times x is zero. The intermittency of renewable energy such as wind and solar require either backup fossil power plants or energy storage capacities.

Storage technologies can only do this tasks with excessive costs. Without fossil power plants to balance the intermittency of renewable energy there will be no guaranteed power supply in Germany, with fatal consequences for the competitiveness of German industry and the manufacturing industry.

It should also be known to the Greens that the expansion of renewable energy due to Germany’s Renewable Energy Law is completely ineffective in terms of CO2 emissions in Europe. The CO2 emissions in Europe are determined solely by the capping of the emissions trading scheme. New wind and solar power, in fact, set more emission allowances free.

These certificates float through the stock exchanges to coal power plants in other EU countries where they allow further increase in CO2 emissions which amount to the same level as the reductions in Germany. Besides additional costs for citizens and the devastation of nature, any expansion of renewable energy will not achieve a single ton of CO2 reduction.

Assumptions of climate policy are flawed

Fossil fuel power plants are not an alternative for Boris Palmer and the Greens because they cause climate change, claiming that “some nature reserves, but also some urban areas cannot be saved from rising sea levels, drought and floods and devastating storms”.

But there are growing signs that the assumptions used for German and European climate policy are flawed. Surprisingly, no global temperature increase has occurred for about 15 years. However, computer models used by climate scientists had predicted a temperature rise of 0.2 degrees Celsius per decade.

In early 2013, 17 renowned climate scientists came to the conclusion that the climate sensitivity of greenhouse gases should be significantly reduced. Hans von Storch, researcher from the Helmholtz Centre in Geesthacht, admits: “First option: global warming is weaker because the greenhouse gases, especially CO2, have a lower impact than assumed. That does not mean that there is no man-made greenhouse effect, only that our influence on the climate system would not be as strong as expected. The other possibility: In our simulations we have underestimated how much the climate varies due to natural causes “.

In fact, there are good reasons for the global warming pause. Solar activity has reached a maximum in the second half of the last century. But since the last eleven-year solar cycle, solar activity has decreased dramatically, the solar maximum exited very quickly. The current solar cycle 24 is the weakest in 200 years.

Ocean currents shift into cold phase

Another crucial error by the Intergovernmental Panel on Climate Change was its failure to take into account the 60-year-old oceanic-atmospheric cycle of the Pacific Decadal Oscillation (PDO) and the Atlantic Multidecadal Oscillation (AMO). The ocean currents change in 30-year intervals between warm and cold phases. They are now moving into a cold phase in which they will remain until 2035. The natural temperature rise in the past was also blamed on CO2, and so scientists got the wrong predictions.

Yes, CO2 is a greenhouse gas; it causes a warming of about 1.1 degrees Celsius per doubling of its concentration. But catastrophic global warming of three to six degrees Celsius this century, which justifies energy policies that threaten the existence of local wildlife, is not to be feared.

The sacrifice of German forests may do for wind energy what the battle against the Whyl nuclear power plant was for Germany’s nuclear energy. None of the political parties represented in the German parliament intends to end this attack on the environment. However, the Green Party would feel the impact most if the growing protest movement against the destruction of nature were to raise this threat onto the political agenda.

Wind weasels try to Deny the Negative Health Effects from Wind Turbines….No Surprise!

Wind turbines make people ill: fact not fiction

Hundreds of thousands of people around the world live near and work at operating wind turbines without health effects. Wind energy enjoys considerable public support, but wind energy detractors have publicized their concerns that the sounds emitted from wind turbines cause adverse health effects. These allegations of health-related impacts are not supported by science. Studies show no evidence for direct human health effects from wind turbines.

It is certainly not me talking.

It is the claim of the American Wind Energy Association (AWEA), the national trade association for the U.S. wind industry. Wind power developers and their lobby groups around the world are shouting the same message – that the noise and vibration (infrasound, sound pressure, and low frequency noise) produced by large-scale wind turbines produce no direct health effects.

In reality, their claim is a lie. There is an ocean of documented evidence to support the assertions of anti-wind campaigners that the noise and vibration from wind turbines causes a range of health problems in significant numbers of people. If you search for just a couple of hours online, you can find personal stories by the thousand, and also numerous highly technical research papers by eminent medics and scientists detailing, amongst others, these symptoms:

  • Chronic sleep deprivation
  • Sleep disturbance
  • Increased blood pressure
  • Increased blood sugar (dangerous for diabetics)
  • Poor concentration and memory
  • Depression
  • Headaches and migraines
  • Dizziness, unsteadiness, ear pain and vertigo
  • Vibration in the body, particularly the chest
  • Nausea/“seasickness”
  • Tinnitus
  • Sensations of pressure or fullness in the ear
  • Stress
  • Panic
  • Annoyance, anger and aggression
  • Increase in agitation by those with Autistic Spectrum Disorder, and ADD/ADHD

Some of these symptoms can be attributed to sleep deprivation. It is increasingly clear from peer- reviewed medical papers that night noise interrupting sleep has an adverse effect on both cardiovascular health and stress levels. Interrupted sleep can also have serious effects on daytime concentration leading, potentially, to increased risk of industrial accidents and road traffic collisions. As these problems are likely to occur at locations remote from the cause of the interrupted sleep they are difficult to attribute to their actual cause. Dr. Christopher Hanning, a now-retired Consultant in Sleep Disorders Medicine to the University Hospitals of Leicester NHS Trust, writes:

In the short term … deprivation of sleep results in daytime fatigue and sleepiness, poor concentration and memory function. Accident risks increase. In the longer term, sleep deprivation is linked to depression, weight gain, diabetes, high blood pressure and heart disease.[1]

I do not pretend to be an expert in the effects of noise, but I do know that in over 30 years as a GP I have seen countless patients presenting with the effects of insomnia, and shift workers in particular suffer far more than the general population with the effects of disturbed sleep. What I find astonishing is that the noise regulations for the wind industry permit MORE noise to be generated by the turbines at night than during the day. This is completely contrary to noise pollution legislation, World Health Organisation (WHO) guidelines – and common sense.

Other symptoms listed above are likely to be a response to exposure to infrasound (sound with a frequency of less than 20 Hz) and low frequency noise (sound with a frequency of less than 200 Hz) produced by the turbines. Both low frequency noise and infrasound occur naturally in the environment (for instance, from household appliances and machinery in the case of low frequency noise, and ocean waves in the case of infrasound). In periods when the wind is blustery, large wind turbines generate both very low frequency sounds and infrasound which can travel much greater distances than audible sound. These sounds are not audible to the human ear, but our brains certainly detect them and some susceptible people suffer some of the unpleasant symptoms I have listed, such as tinnitus, ear pain and vertigo. If you feel up to reading some technical, but very interesting, research on this subject, take a look at “Wind-Turbine Noise. What Audiologists Should Know” by Punch, James and Pabst, published in the American publication Audiology Today in 2010.[2]

Other reasons why people experience health impacts from wind turbines include the swishing or thumping of the blades, which is highly annoying as the frequency and loudness varies with changes in wind speed and local atmospheric conditions. This is not at all like the sound of a passing train, aeroplane or tractor which moves on rapidly to be replaced by less intrusive background sounds. The noise of wind turbines has been likened to a “passing train that never passes” which may explain why it is prone to cause sleep disruption.

Some of those with heightened sensitivity to specific repetitive stimuli, such as those with Autistic Spectrum Disorder, Attention Deficit Disorder or Attention Deficit Hyperactivity Disorder (ADD/ADHD), can be seriously affected by the noise. Consultant clinical psychologist Dr. Susan Stebbings, from the Lincolnshire Partnership NHS Trust, said more research was needed into wind turbine noise and these disorders:

Because it is clear from our clinical knowledge of the condition of autism that the sensory difficulties individuals can have are possibly going to be impacted on by the presence of such large sensory objects in their environment.[3]

Indeed, there is at least one case on record of a wind farm application being turned down because of the proven impact on children with autism.[4]

Then there is shadow flicker or strobing which occurs when the rotating blades periodically cast shadows through the windows of properties. This can be truly unpleasant to live with and can trigger migraine and – much more rarely – epileptic fits in those suffering from photosensitive epilepsy.[5] At night, the red warning lights on the tops of some turbines can cause blade glint and strobing effects, so it is not just a daytime phenomenon.

Then there is the effect of stress. If you live in a tranquil rural area like ours, where the daytime and night time noise levels are almost always very low, you may well suffer varying levels of stress from the imposition of industrial-scale wind turbines into the landscape. The stress can occur long before the turbines are erected: during the planning process; during the noise and disruption of the construction; when you see the turbines for the first time and cannot believe the scale of them; and, then, during their operation when your sleep is disrupted and other physical and mental symptoms present themselves.

The effects of wind turbine noise have been known for several years now. In February 2007, a Plymouth GP, Dr. Amanda Harry, published a report “Wind Turbines, Noise and Health”.[6] The report documents her contacts with 39 people living between 300 metres and 2 kilometres from the nearest turbine of a wind farm. She discovered symptoms such as those I have outlined experienced by people living up to 1.6 kilometres from the wind farms.

The wind industry has repeatedly tried to discredit Dr. Harry’s report, and another – published in 2009 – by a leading American Pediatrician Dr. Nina Pierpont, who coined the phrase “Wind Turbine Syndrome” to cover the range of health problems she investigated over five years in the US, the UK, Italy, Ireland and Canada.[7] The global wind industry also spends vast sums attempting to discredit scientifically sound research studies, and the papers of experts in the physiology of the ear that prove infrasound can have adverse effects despite it not being audible.

It is true that both Dr. Harry’s and Dr. Pierpont’s research is largely anecdotal and does not reach the high standards needed for statistical validity. However, that also applied to reports on the association between lung cancer and smoking, and asbestos and asbestosis, in the early days.

We have now reached the stage in the debate when there can be no reasonable doubt that industrial wind turbines – whether singly or in wind farms – generate sufficient noise to disturb the sleep and impair the health of those living nearby.[8] In fact, our own Government has long been fully aware of the problems, as demonstrated in a 2008 Economic Affairs Committee Memorandum by Mr Peter Hadden, which concludes that:

onshore wind turbines built within 2km of homes offer no benefits and should not be part of a plan to provide the UK with a viable, secure, predictable supply of electricity. Indeed, onshore wind turbines ensure an unpredictable energy supply, by the very nature of the wind, with a long list of adverse impacts that diminish their supposed usefulness. Other renewables, such as solar and hydropower, offer more options and more predictability, especially combined with the still necessary (and technologically advancing) conventional sources of energy.[9]

I find it unbelievable that the wind industry is permitted to inflict health nuisance such as sleep disturbance, stress, and headaches on our communities – let alone more serious health issues such as depression, and heart and diabetes problems. To suggest, as the wind industry does, that there is “no problem” when faced with the huge body of evidence from around the world is perverse.

What sums up this entire problem for me is the quote below. It is by Dr. Noel Kerin of the Occupational and Environmental Medical Association of Canada. He was attending the First International Symposium on Adverse Health Effects and Industrial Wind Turbines, held in Canada in October 2010. He was shocked by the overwhelming evidence on the harmful effects of wind turbines:

First we had tobacco, then asbestos, and urea formaldehyde, and now wind turbines. Don’t we ever learn? Our public health system should be screaming the precautionary principle. The very people who are sworn to protect us have abandoned the public.[10]

My extensive reading into the harmful effects of wind turbines leaves me in no doubt that, to protect our community, we need to oppose the erection of three 125 metre turbines on Berry Fen.* Quite aside from the damage to our beautiful landscape, our tranquillity, our tourism industry, and wildlife, this wind farm would have serious implications for the health of many who live and work here for the entire 25-year life of the wind farm, and well beyond.

The Wind Turbine Scam is Destroying Our Economies, as Well as Our Communities!

As STT followers are acutely aware, wind power is an economic and environmental fraud. Because wind power can only ever be delivered at crazy, random intervals – and, therefore, never “on-demand” – it will never be a substitute for those generation sources which are – ie hydro, nuclear, gas and coal (see our posts here and here and here and hereand here and here and here and here).

Were it not for government mandates – backed by a constant and colossal stream of subsidies (see our post here) – wind power generators would never dispatch a single spark to the grid, as they would never find a customer that would accept power delivered 30% of the time (at best) on terms where the vendor can never tell customers just when that power might be delivered – if at all (see our post here).

Ultimately, it’ll be the inherently flawed economics of wind power that will bring the greatest rort of all time to an end. The policies that created the wind industry are simply unsustainable and, inevitably, will either fail or be scrapped.

The Canadians are reeling under the ludicrous wind power policies of a hard-green-left Liberal government, clearly intent on committing economic suicide. Power prices – driven by exorbitant guaranteed rates to wind power outfits – have rocketed – tripling in less than a decade, driving energy intensive businesses – like manufacturing – out of business or offshore – stifling business investment – killing off or threatening thousands of sustainable (unsubsidised) jobs across Canada and otherwise creating economic chaos (see our post here).

The scale and scope of Canada’s wind power disaster hasn’t been lost on top energy market economists, like Ontario’s Professor Ross McKitrickfrom the University of Guelph.

Rebecca Thompson: First we turn to Professor Ross McKitrick, an economist. He recently published a very scathing review of how economically unsound the Ontario Liberal government’s Green Energy Act is.

Professor Ross McKitrick: Well the important thing to understand about wind turbines is that they don’t run on wind, they run on subsidies.

Rebecca Thompson:  We went to see McKitrick at the University of Guelph.

Professor Ross McKitrick:  All the arguments that they’ve put forward for the Green Energy Act they really turned out to be phoney once we looked at them closely. They said that it would improve the economy, reduce air pollution emissions and it would replace coal fired power. And the problem is with the first one, it is not going to improve the economy because of what you are doing is replacing power that costs 3 to 5 cents per kilowatt hour to generate, and you’re replacing it with power that costs at least 13 1/2 cents per kilowatt hour to generate. So you’re raising the cost of doing business, it will drive down the rate of return in manufacturing and mining and that has to translate into job losses and reduced investment and shrinking the economy.

Rebecca Thompson: So you’ve pointed out that wind energy in fact, isn’t in the public interest in the short term but will it be in the long term?

Professor Ross McKitrick:  Nobody was building wind turbines in Ontario until the government started throwing money at it. It is not a profitable source of electricity, it’s not cost-effective. Wind turbines can’t compete on the wholesale market without a lot of government support.

Rebecca Thompson: The system used to fund wind energy in many places around the world is called a Feed-In-Tariff (FIT).

Professor Ross McKitrick:  And that means if you build a bank of wind turbines somewhere, and you get the contract that everyone is looking for you get a guarantee of 20 years being paid 13 1/2 cents per kilowatt-hour for the electricity that’s generated while the wholesale rate in Ontario is typically between 2 – 4 cents per kilowatt hour.

Rebecca Thompson: The Ontario government piggybacked off what is a European idea of a feed in tariff policy where the prices are locked in for 20 year contracts. And here’s another head scratcher …

Professor Ross McKitrick: The other provision of the contracts is that the system has to buy the power from you whenever you produce it. So the standard power plants, nuclear plants and hydro plants and so forth – there is no guarantee for them to buy their power, they have to compete on a wholesale market they have to price their product, in this case electricity, so that the system operator will buy it. With wind turbines, if the blades are running, the system operator has to buy it. Now they have adjusted that slightly in the last year because of this problem of the system operator being forced to buy tons and tons of power when it doesn’t need it, at 13 1/2 cents per kilowatt hour and sell it on the export market at one or two cents per kilowatt-hour – it was costing hundreds of millions of dollars a year for the system operator to do that. So the province now allows the system operator to reject some of the power that the wind turbines produce and instead the province will pay the wind turbine owners a benefit for what they call ‘deemed production’. So it’s really just transferred that same costs on to the taxpayer now.

Rebecca Thompson: The bottom line is pretty good for the wind energy sector.

Professor Ross McKitrick:  They get a 20 year contract to sell wind power at far above market rates and it doesn’t matter that they are generating power at times when the province absolutely doesn’t need it, and we can’t use it, and we just have to try to find some neighbouring jurisdiction to buy it from us. We used to have a few large power plants in Ontario and we had our grid that was optimised to source electricity from a few large central locations. We’re now shutting down the large central locations and replacing them with this proliferation of tiny little unreliable wind farms and you have to build a whole new grid to accommodate that. So that’s again an extra cost to get something that we already had.

Rebecca Thompson: What’s more is that the Green Energy Act hasn’t even come close to creating the number of jobs the Liberals claimed it would.

Professor Ross McKitrick: It turned out that the province had claimed that there were going to be 50,000 new jobs created from the Green Energy Act. When the Auditor General asks them to back that up because it doesn’t really make sense that this would create any jobs – what they admitted was they were really talking about were temporary construction jobs – as you put up wind turbines you need some workers in to do that. But then once the wind turbines are built, then those jobs disappear and there are no ongoing jobs. In economics, it’s an old fallacy, what’s called the broken window fallacy. If you go around breaking shopkeeper’s windows, since they have to hire repair people to fix the windows then you’ve somehow improved the economy. But, you haven’t. All you have done is increase the cost of having what you had before – which was windows in stores.

Rebecca Thompson: If the new shift to green power is so inefficient why hasn’t anyone working in the system spoken out?

Professor Ross McKitrick:  There are a couple of reasons. The power workers union has spent money on advertisements. They did try to fight against the closing of Lambton and Nanticoke – they understood that this was a bad deal for the workers in the province. But they did want they could. But it’s hard to be up against a government that is pushing so much propaganda on coal. There were people certainly in the power generating sector that understood that the government’s numbers weren’t correct and didn’t add up. But, they were effectively muzzled.

Rebecca Thompson: McKitrick speaks to people all the time about the changes in the system.

Professor Ross McKitrick:  I do find people working in the power sector, they know that this is a crazy system. These wind farms are displacing hydro electricity which is just a waste on every level because we have the hydroelectric facilities, they don’t generate any air pollution emissions. They give us reliable, predictable baseload power. And now we run wind turbines and let those hydro-facilities sit idle. So people who work in the sector, they can see what’s going on and they know that this is a waste. But, for understandable reasons they’re not about to make a big noise about it because they could lose their jobs if they do.

Rebecca Thompson: Whether any government would actually be able to get out of existing contracts is debatable. Ross McKitrick says it’s possible.

Professor Ross McKitrick: One option might be to buy out some of the wind turbine companies and take those wind turbines off the grid, or only use their power when they’re competitive. In Europe, what governments have started to do though is put on special new taxes on renewable sources, solar and wind, to try and recover some of these costs. Alternatively, the government may look to try and tear up the contracts and accept the legal liability that goes with it, but it’s not going to be easy.

Denmark High Court Rules on Compensation for Noise from Wind Turbines!

DENMARK: HIGH COURT RULES ON COMPENSATION FOR NOISE FROM WIND TURBINES

Background

Depending on their location, wind turbines can cause noise, visual interference and light reflections.

These issues are governed by public and private law, including neighbour law. The main rules regarding noise from wind turbines can be found in Executive Order 1284 of December 15 2011 on wind turbine noise, issued pursuant to the Environmental Protection Act. To some extent, the order safeguards neighbours from noise inconvenience by establishing maximum noise levels from wind turbines in outdoor areas. The noise limit varies depending on the surroundings.

Wind turbines may also cause visual interference which may negatively affect the value of surrounding properties. Thus, the location of wind turbines on land has proved a difficult political issue for years. Every municipality supports the idea of more wind turbines – just not within its own borders.

In order to promote local support for wind energy projects, the Parliament passed the Promoting Renewable Energy Act, which establishes a compensation scheme for neighbours of wind turbines. Under the scheme, those who build one or more wind turbines are obliged to compensate their neighbours for any reduction in property value that the wind turbines may cause, regardless of whether the wind turbines accord with the necessary permits.

The compensation scheme departs from the court-based neighbour law in that it does not operate with a tolerance limit which the neighbour must prove has been exceeded.

The starting point is that the issue of compensation must be settled before the wind turbines are built. However, the Promoting Renewable Energy Act does allow neighbours to claim compensation in certain circumstances thereafter. The competent authority to deal with claims for compensation is the assessment authority set up by the act.

Compensation granted to neighbours under the act has been relatively low so far.

Facts

In a recent case before the High Court for Western Denmark the plaintiffs had been awarded Dkr250,000 in compensation for the erection of eight wind turbines by the assessment authority. They brought the matter before the courts seeking higher compensation.

Before the erection of the wind turbines, an environmental study had concluded that the noise level at their property would amount to 38.8 decibels at wind speeds of 12 knots and 40.9 decibels at wind speeds of 16 knots.

Before the city court, a court-appointed expert stated that the reduction in the value of the property amounted to between Dkr600,000 and Dkr800,000. The city court also arranged a visit to the property.

Where the assessment authority found that the plaintiffs’ property would be subject to limited noise pollution, the city court found the level to be more significant. The court further ruled that the plaintiffs had documented their loss of value at Dkr600,000 and thus awarded them an additional Dkr350,000.

Finally, the court held that the plaintiffs had suffered no other economic loss covered by the Promoting Renewable Energy Act. In particular, the court held that the fact that the wind turbines had been erected with all necessary permits prevented the plaintiffs from claiming compensation under neighbour rules.

The High Court for Western Denmark upheld the city court’s judgment, but fixed the compensation at Dkr500,000 because, among other things, there were certain deficiencies in the masonry of the house. However, the court also considered the findings of the court-appointed expert witness who had seen the plaintiffs’ house after the erection of the wind turbines – which the assessment authority had not done – as well as the city court’s own observation of the property. Finally, the court ruled that the Promoting Renewable Energy Act does not restrict the courts’ competence to review decisions from the assessment authority.

Comment

The judgment is significant as it granted compensation after the erection of the wind turbines. This is contrary to the main rule in the Promoting Renewable Energy Act; however,both the city court and the high court found sufficient legal authority under the act to admit the claim after the erection of the wind turbines.

Moreover, both courts paid considerable attention to the evaluation of the court-appointed expert. While this is quite normal in Danish case law, it is unusual in cases where an authority such as the assessment authority has previously dealt with the matter.

Finally, the high court paid attention to the city court’s own observations of the property. It is quite unusual to see such a reference to the observations of a lower court in a higher court’s grounds of judgment.

The judgment gives cause for optimism to those who intend to challenge decisions of the assessment authority under the Promoting Renewable Energy Act. From a procedural point of view, it seems to be important for the court to see the property at issue to form its own opinion of the level of noise pollution caused by wind turbines.

A petition on the internet working for a minimum distance of one mile between new windmills and buildings.

 

The motivation: “We ask for respect between wind turbines and places where people live and / or work a minimum distance of 1,500 meters.  We are not against green energy in itself, but each technology has its own place and this must not be at the expense the quality of life of local residents. “

The initiative was taken by Annemarie Francois (Oud-Heverlee) with from the first day also signatories Outgaarden. The list is submitted to the Flemish government.

Wind energy is becoming a prominent feature of both economic and visual landscapes across the United States. Wind turbines, like the one here in Decorah, are a sustainable energy resource, and help keep our air clean by reducing greenhouse gas emissions. But what effects do they have on the local wildlife, and how can any threats be minimized?

This summer, the Luther College Biology Department is investigating the Luther College wind turbine’s impact on bats. Dawn Reding, Luther visiting assistant professor in biology, and students Mariah Crotty and Andrea Malek are using several methods to survey bat populations and estimate bat mortality caused by the sweeping rotor blades.

Three acoustic monitoring sites have been set up around Decorah to learn more about species presence and abundance, and the researchers are conducting daily searches around the turbine to look for bat carcasses. Eight species have been detected in the area, and each detector has recorded from 50 to 600 bat calls per night this summer. Although a few carcasses have been found beneath the wind turbine, additional monitoring and analysis will be necessary to better estimate the turbine’s impact.

Bats are a very important part of the environment, and eat annoying insects, with some species eating 500 to 1,000 mosquitoes in a single hour.
With their work, the researchers aim to learn more about the bats in northeastern Iowa and provide information needed to lessen human impact on the area’s wildlife.

Seven landowners filed a class-action lawsuit this week to prevent wind turbines from being built near their homes in Canadian and Kingfisher counties.

In the complaint, which is embedded above, the landowners claim that planned wind farm projects controlled by Virginia-based Apex Clean Energy would create a nuisance, devalue their property and adversely affect their health.

The landowners who brought the lawsuit all live within three miles of the planned wind farm, and, in many cases, own property within the “no-build” zone of the planned locations of the 500-foot-tall turbines. From the complaint, with bullets added for readability:An organization that opposes wind projects in the two counties, the Oklahoma Wind Action Association, brought the lawsuit on behalf of the landowners. The suit was filed Aug. 27 in the U.S. District Court for the Western District of Oklahoma.

  • … Industrial Wind Turbine manufacturers recommend a minimum setback or safety zone of three (3) times turbine height—in this case fifteen hundred (1500) feet—between any home and an Industrial Wind Turbine for safety purposes in case of catastrophic failure of one or more components, not to protect against adverse effects resulting from noise.
  • As a result, Industrial Wind Turbines, by their own safety standards, create a de facto “no-build” zone in a fifteen hundred (1500) radius surrounding the Turbine. In many instances, this “no-build” zone overlaps with the property of landowners who have no agreement with Defendants.
  • This invasion of Plaintiffs’ right to use and enjoy their property requires Defendants to obtain an easement from the landowner that restricts their ability to construct upon any property within the fifteen hundred (1500) feet of the Industrial Wind Turbine. Otherwise, Defendants’ Industrial Wind Turbines will interfere with Plaintiffs’ ability to use their property as they wish safely.
  • Defendants have undertaken no effort to obtain such easements and Plaintiffs will be left with a cloud upon their titles.

The wind energy industry is booming in Oklahoma, which was the country’s fourth-largest wind-power producer in 2013. But there has been consierable resistance to some wind farm projects, including the Apex projects planned for Canadian and Kingfisher counties.

In December 2013, officials in the nearby city of Piedmont approved an agreement with Apex to settle a heated, year-long fight to block wind farm construction near the city. Officials in Kingfisher, too, are negotioating with Apex on a similar setback agreement, according to the lawsuit.

On Sept. 11, the Oklahoma Corporation will hold its first public meeting to discuss potential statewide rules for the wind energy industry, an action requested by Sen. President Pro Tempore Brian Bingman, R-Sapulpa, which was spurred by vocal opposition to proposed wind farm projects in Osage and Craig counties.

During the webinar, Justin Rolfe-Redding, a doctoral student from the Center for Climate Change Communication at George Mason University, discussed ways for wind-energy proponents to get their message out to the public.Rolfe-Redding said that polling data showed that “after reading arguments for and against wind, wind lost support.” He went on to say that concerns about wind energy’s cost and its effect on property values “crowded out climate change” among those surveyed.

 

The most astounding thing to come out of Rolfe-Redding’s mouth — and yes, I heard him say it myself — was this: “The things people are educated about are a real deficit for us.” After the briefings on the pros and cons of wind, said Rolfe-Redding, “enthusiasm decreased for wind. That’s a troubling finding.”

Australian Wind Industry Doomed: Tony Abbott Signals the End of the Mandatory RET

STT followers have been delighted with news that Tony Abbott, Joe Hockey and Mathias Cormann have teamed up to axe the mandatory RET (see our post here).

In response to the PM’s mooted plan, the wind industry and its parasites have been reduced to making idle threats of “revenge” and bleating about “sovereign risk”. Despite a rear-guard effort by Environment Minister, Greg Hunt to salvage something of the mandatory RET, his boss has confirmed that his mission is to kill it outright. And that pretty much means the end of the wind industry as we’ve known and grown to despise it. Here’s the Australian Financial Review on the beginning of the end.

Pleas by solar and wind companies to leave the Renewable Energy Target untouched have fallen on deaf ears with the government deciding to proceed with a phasing down of the scheme.

While a final position will not be announced until next month, The Australian Financial Review understands the intent is to cut the scheme harder than a compromise scenario that was being pursued by the Environment Minister, Greg Hunt.

The end result will be closer to the abolition scenario advocated by Prime Minister Tony Abbott which would end the scheme by closing it to new entrants and grandfathering existing large scale projects.

Seeking to overcome the cabinet split, Mr Hunt, Mr Abbott and Industry Minister Ian Macfarlane met on Sunday to discuss a policy position to be put to the bureaucracy for analysis and then to the cabinet for a final decision.

The government is being guided by the findings of the review into the RET conducted by businessman Dick Warburton, a person the industry has argued is ill-suited to the task because he is a climate-change sceptic.

The guiding principles of the final decision will be to balance investor risk with the impact of the RET on household and business power bills. Mr Abbott claims the RET has had a significant impact on power prices. The government’s own modelling shows while the RET has added $40 a year to average household power bill, prices will fall over the medium term as more renewable energy is produced.

The industry is ramping up its warnings that any dilution of the current scheme will not only jeopardise more than $11 billion in the renewable energy investment pipeline, but create a broader sovereign risk perception for Australia.

Close watch on outcome

Philip Green, the London-based partner of the Children’s Investment Master Fund (TCI), which has a 33 per cent stake in renewable energy company Infigen, said the issue was being watched closely. “Sovereign risk has already increased in Australia given the media coverage of the carbon debate and now the RET. Sovereign risk will increase more if the stories about cuts to the RET are confirmed,” he said in a statement.

“This comes at a cost to the nation through higher capital costs as it seeks future investment in infrastructure. The Australian RET had strong bi-partisan political support [including from the current prime minister]. It can take a long time to restore trust and in some cases this is only achieved with a change in leadership/policy/party.”

Under the RET, a policy which hitherto had bipartisan support, 20 per cent of Australian’s energy production by 2020 would come from renewable sources. Based on earlier predictions of power production in 2020, this 20 per cent target was calculated at an annual production of 41,000 gigawatt hours.

But the 2020 production total has been downgraded following the decline of the manufacturing sector, including automotive and aluminium.

Consequently, 20 per cent of the revised production target is 27,000 GWh. This is the “real 20 per cent” scenario for which Mr Hunt is advocating.

Under the push by Mr Abbott, renewable energy output would be frozen at current levels of about 16,000 GWh.

Any proposed change faces a near impossible passage through the Parliament with Labor and the Greens opposed to any alteration, while Clive Palmer says he will not allow any change unless Mr Abbott goes to the next election in 2016 and wins a mandate.

STT thinks the constant reference to Dick Warburton as a “climate-change sceptic” is just churlish bitterness from the vanquished. From STT’s viewpoint, Dick did precisely what he was supposed to do: standing up for Australian power consumers and helping to bring an end to the most costly and pointless piece of policy ever devised.

And, yet again, the wind industry – and those with shirts to lose when it collapses – trot out the furhpy about “sovereign risk”. Not only is it utter bunkum (see our posts here and here and here and here), harping on about it won’t save the wind industry from the inevitable demolition of the mandatory RET.

The AFR talks about Australia risking “$11 billion in the renewable energy investment pipeline” as if that were some kind of loss to Australian power consumers, in an already over-supplied market. As we’ve previously pointed out, the threatened “investment” is hardly a “no-strings attached-gift”. The would be investors are after annual gross returns in the order of 20% on that figure – ie, a cool $2.2 billion, every year – which can only be recouped from power consumers through higher power bills – with a fat pile of RECs underwriting the “investment” (see our post here).

As a piece of friendly advice, we wouldn’t be betting the house on Clive Palmer blocking any changes to the RET in the Senate. Horse trading is the life-blood of politics; and a week can be a very long time for anyone engaged in the political caper. As you’d expect, STT hears that Tony Abbott is already doing business with the Senate’s cross-benchers, including the PUP in order to come up with a workable solution to the debacle that is the mandatory RET, which has utterly failed as a cost-effective CO2 abatement policy.

Clive Palmer wants an Emissions Trading Scheme (albeit with the price of credits set at zero). So the Coalition’s Direct Action policy is being reworked by top energy market economist, Danny Price in a manner that will not only resemble something like what Clive is after, but in a way that will slash the value of the subsidies to wind power outfits (as promised by the RET) by around 90%. One of the cross-benchers, Nick Xenophon – who works closely with Danny Price – is in on the mission to kill off the wind industry, by introducing some tweaks of his own to Coalition policy, aimed at achieving least-cost CO2 abatement (see our posts here andhere). Another cross-bencher, David Leyonhjelm penned a piece for The Australian today (we’ll cover it shortly) setting out his eagerness to kill the mandatory RET, which he sees as “just government mandated corporate welfare” that will cost power consumers $billions “for no measurable environmental benefit”. No, STT didn’t write David’s article.

But, in the result, whether or not changes to the mandatory RET occur during the life of this parliament is a matter of passing academic interest. The wind industry is doomed simply because – from here on – NO retailer in touch with their earthly senses will enter a long-term Power Purchase Agreement with a wind power outfit – which means that those desperados still hoping to build wind farms will never obtain the finance needed to do so. Moreover, the REC price is bound to head south over the coming weeks and months, placing outfits with current wind farm operations in mortal financial jeopardy.

One of those facing an early exit from the stage is our old favourite, Infigen. These boys have just announced an $8.9 million loss for 2013/14, which follows a $55 million loss in 2011/12 and an $80 million loss for 2012/13 (see our posts here and here). Those hefty losses were all racked up at a time when the mandatory RET was set in stone, such that the regulatory cards were all firmly stacked in Infigen’s favour.

With the mandatory RET set for the chop, Infigen is preparing to emulate its predecessor (Babcock & Brown) with another spectacular financial collapse. Here’s the Australian Financial Review setting the scene for Babcock & Brown Mk II.

Wind power producer Infigen Energy has warned it could fall into breach of its debt covenants within three months should the 2020 Renewable Energy Target be wound back with no compensation for affected investors.

Managing director Miles George said either of the two outcomes apparently being favoured by the government for the overhaul of the RET would be “disastrous” for both the industry and Infigen.

He said significant write-downs would follow, with the loss of value for Infigen more than its current market cap of about $185 million.

The government is thought to be considering two potential outcomes for its RET review, one involving reining the 2020 target back to represent a “real” 20 per cent of electricity use, rather than the 26 per cent to 28 per cent it is currently expected to represent.

The other involves closing off the scheme to new entrants, while honouring existing contracts only.

“Either of these scenarios is disastrous for our industry,” Mr George said, after Infigen posted an $8.9 million full-year net loss, affected by the regulatory uncertainty. “They are both death for the renewable energy industry and, to be frank, they are death for Infigen.”

He said if no compensation was provided for investors, the resulting weakness in the price of large-scale renewable energy certificates would cut cash flow for debt servicing. As a result, Infigen would be at risk of breaching its covenants within three months.

If you watch much mainstream TV, you’ve probably seen Siemens’ new multi-million-dollaradvertising blitz  to sell the American public on industrial wind. Why the sudden ad onslaught? Watch the video below.

The wind business abroad has taken a huge hit of late. European countries have begun slashing renewable mandates, due to the ever-broadening realization that renewables cost far more than industrial wind proponents have led people to believe: economically, environmentally, technically, and civilly.

Siemens’ energy business took a €48m hit in the second quarter due to a bearings issue with onshore turbines, and a €23m charge due to ongoing offshore grid issues in Germany – on top of subsidy and feed-in tariff cutbacks, recent articles have pointed out.

As Siemens’ tax-sheltering market dries up in Europe, its U.S. marketing efforts are clearly geared toward increasing its income and profits via wind’s tax sheltering schemes in the United States. The company stands to make millions, so Siemens ad campaign is obviously part of an overall pitch to persuade Congress to extend the hefty wind Production Tax Credit (PTC), more accurately called“Pork-To-Cronies.” As Warren Buffett recently admitted, “We get tax credits if we build lots of wind farms.  That’s the only reason to build them. They don’t make sense without the tax credit.”

Taxpayers and ratepayers, beware!

President Obama often says he intends to “close corporate loopholes,” but his PTC and other policies continue funneling billions of taxpayer dollars to his wealthy corporate insiders and campaign contributors – while we continue to rack up unconscionable debt for our children and grandchildren.

Increasing public awareness of the wind energy scam has led to increased opposition to extendingany more corporate welfare to Big Wind via the PTC and energy investment tax credit (ITC). Enter another bureaucratic end-run around once clear statutory language by this Administration.

As reported by the Wall Street Journal, the increasingly politicized IRS recently relaxed the definition of “commence construction” to the point where the definition bears no resemblance to the actual words.  During a hearing by the House Energy Policy, Health Care and Entitlements subcommittee last October, Curtis G. Wilson of the IRS admitted that developers can now game the system to the point where projects built years in the future could still meet the eligibility requirement for “commence” now.

U.S. taxpayers and ratepayers are doomed when, instead of allowing the markets to work, crony-corruptocrats are picking the winners and losers in the energy marketplace, using such nefarious tactics.

Sadly, most people don’t even know the difference between energy and power. This reality has built the framework for the biggest swindle ever perpetrated on citizens worldwide.  Many have bought into the alarmist argument that “we have to do something” to stop “dangerous manmade global warming.” Enter the wind industry sales department, primed to capitalize on public fears and alarmist hype.

Siemens also needs to convince the 80% of U.S. citizens who live in suburbia that industrial wind factories are “environment-friendly,” and everyone loves them. Thus, as usual for these disingenuous ad campaigns, a sprawling wind facility is pictured among green fields, with no homes anywhere to be seen, no birds are being slaughtered, while a happy Iowa leaseholder smiles and says she loves wind.

A drive out Route 20A in Wyoming County, western New York State, however, tells a far different story. The western side of Wyoming County – which used to be some of the most beautiful countryside in New York State, has been industrialized with 308 giant, 430-foot-tall towers, and their 11-ton, bird-chopping blades spinning overhead, only hundreds of feet from peoples’ homes and roadways. There’s no doubt that Siemens won’t be showing you this reality in any of their TV ads!

Unfortunately for the residents of Orangeville in Wyoming County, greed at the top in Washington, DC determined their fate. The sole reason Invenergy went ahead with its plan to build its 58-turbine project was that, in the early morning hours of January 1, 2013, the PTC was added as pork for companies sucking at the wind welfare teat.

Ever appreciative of the handouts, Invenergy owner Ukrainian Michael Polsky rewarded President Obama by holding a $35,000 a plate fundraiser at his Chicago mansion. Mr. Obama is so committed to Big Wind that he’s even legalized 30-year eagle kill permits just for the wind industry. Anyone else harming an eagle, or even possessing a single bald eagle feather, is penalized with an iron fist.

There you have it – corporate cronyism in all its glory, with bird murder as its crowning achievement.

Word of impending lawsuits lingers in Orangeville. It remains to be seen if disenchanted leaseholders will end up suing Big Wind, as others have. In the meantime, we’re hoping we don’t have any 11-ton blade breaks that throw shrapnel for thousands of feet, or any airplanes crashing into wind turbines during fog, as occurred in South Dakota earlier this year, killing all four on board. (I’ll bet you won’t be seeing any of these facts in Siemens’ ads, either.)

Our elected officials need energy literacy. Even a small dose would help.

What’s most frustrating, when attempting any kind of correspondence regarding these energy issues with many elected officials, is the kind of response I received from Senator Chuck Schumer (D-NY)when I wrote him a letter about ending the Wind PTC. Senator Schumer never even mentioned the PTC in his response. Instead, he rambled on about the need to “reduce foreign oil imports,” and increase “efficiency” – neither of which has a thing to do with wind-generated electricity.

Mr. Schumer recently feigned alarm following complaints by citizens about soaring electric rates – demanding answers about it, while simultaneously supporting yet another Wind PTC extension (plus other rate-increasing “renewable” projects). Senator Schumer’s hypocrisy is outrageous, and unacceptable.

Perhaps it’s time for U.S. ratepayers and taxpayers to demand that their elected officials first pass an energy literacy exam, before they pass such cost-exorbitant, “green” boondoggles on to consumers.

Congress is on vacation through Labor Day, which makes this the perfect time to approach your senators and representatives while they’re home.  Attend town hall meetings and in-district fundraisers. Remind your representatives that we put them in office, and that we can also vote them out!

Since energy plays a pivotal role in our national economy – impacting the cost of absolutely everything else – candidates should have “energy” listed on their “issues” webpage.

Good candidates will support an All of the Sensibleenergy policy, as opposed to the “All of the Above” energy policy which President Obama has been pushing on behalf of the “green” movement.“Sensible” alternative energy options are those that are backed up by scientific and economic proof that they provide net societal benefits. Industrial wind fails this test miserably!

Continue to call and write their offices, and encourage them to oppose any extension of the PTC and ITC! Write letters to your local newspapers, copy their district offices, and post information on their social media pages (e.g., Face Book & Twitter).

We must demand accountability from elected officials, or vote them out! Reliable, affordable energy is what has made America great. We need to keep it that way.
